TBT Agreement aims to ensure that technical regulations, standards, and conformity assessment procedures are non-discriminatory and do not create unnecessary obstacles to trade.

The TBT Agreement strongly encourages members to base their measures on international standards as a means to facilitate trade. Through its transparency provisions, it also aims to create a predictable trading environment. The agreement still allows countries to use different standards and different methods of inspecting products.

But what does Legitimate objective means?

According to art.2.2 : national security requirements; the prevention of deceptive practices; protection of human health or safety, animal or plant life or health, or the environment. In assessing such risks, relevant elements of consideration are, inter alia: available scientific and technical information, related processing technology or intended end-uses of products.

-We also have to know that according to the TBT Agreement,that products originating in the territories of other Members should not be less favorable than domestic products, as stablished in Art.5.2.1
